It has been announced that with effect from 1 February 2011, there will be an increase in the annual compensation limits within Employment law. This is as a result of the Employment Rights (Increase of Limits) Order 2010.

The main changes include the following:-

  1. Where a dismissal is found by a Tribunal to be unfair on the basis that it was carried out on the grounds of an employee’s trade union membership or activity, the minimum limit of compensation for a finding of unfair dismissal is to be increased from £4,700 to £5,000.

  2. Where a dismissal is found by a Tribunal to be unfair, the maximum limit of the possible compensatory award is to be increased from £65,300 to £68,400.

  3. The maximum amount of “week’s pay” for the purpose of calculating a redundancy payment, or for various awards including the basic or additional award of compensation for unfair dismissal is to be increased from £380 to £400.
