Unfair Dismissal Claims: Deadline Disaster?

There will no doubt currently be some significant eyebrow raising amongst employers stemming from a recent Employment Appeal Tribunal (EAT) case, which appears to have thrown the door open to claimants to make presentation of complaints to employment tribunals outside of the specified 3 month time limit.

Employers should certainly familiarise themselves with the decision of the EAT as it may be that the 3 month deadline for unfair dismissal claims will no longer be as rigorously observed as it once was…

Human Rights: A Right to be Represented at Disciplinary Hearings

The Supreme Court has this year considered an appeal relating to Article 6 European Convention on Human Rights (ECHR) and its impact on the right to receive legal representation at disciplinary hearings. The Court overturned the decision of both the High Court and the Court of Appeal, finding that in the current case Article 6 did not apply to the proceedings in issue.

Agency Worker Regulations

The Agency Workers Regulations 2010 are due to come into force on 1 October 2011.
Employers need to be aware of the changes these Regulations bring, if running an employment agency or using agency workers as a hirer.
