Court proceedings and actions
Court proceedings are issued in the High Court and County Court
Confirmation that proceedings have been issued and dates for your debtor to respond are provided to you
By issuing court proceedings if the debtor fails to defend the claim within the relevant time periods (outlined below) you will be entitled to request a Court Judgment be entered against your debtor (unless it is exempt from registration). Registration of a Court Judgment will affect your debtor’s ability to obtain credit
Once proceedings have been issued and served the Defendant must, within 14 days of service, either:
admit the debt and pay or offer to pay in instalments
or file a Defence or an Acknowledgement of Service form followed by a Defence
The Defendant can issue a counterclaim with their Defence
If the claim is admitted or paid, or the Defendant fails to file an acknowledge of service and/or fails to file a Defence you are entitled to Judgment, which we will obtain on your behalf
