If both parties to a divorce or separation are able to settle financial matters, then we can draw up a Consent Order.

This can deal with the division of property, money, life insurance, savings, pensions, and so on.

You can also agree the amount of maintenance to be paid for the children and so avoid applying to the Child Support Agency.

Both of you must sign the consent order, and complete a form known as a ‘Statement of Information’ form. This will set out your financial circumstances and future plans regarding remarrying and cohabitation.

This is sent to the court and will help them decide if the agreement is fair. They will approve it, or if unhappy with it ask us to send them more information or attend court to discuss its contents.

The consent order is a binding contract. If one party breaks the agreement, you can go to court to see that it is enforced.
