In the event of a divorce or separation, financial provision may be needed for a spouse with no income or a low income and for the children. This is called maintenance, and is usually paid by the financially independent partner.
How do I apply for maintenance?
You can apply yourself in several ways, and it is best to get good legal advice beforehand. Examples of things you can do include:
- Applying to the court for a 'periodical payments' order in which your partner pays a certain level of payments over a given period of time
- Applying to the Child Support Agency for maintenance for the children
Can a court decision be avoided?
It is possible to settle your maintenance matters with a Consent Order. This is an agreement drawn up by a solicitor and approved by the Court.
