If the Social Services wish to take your children away from you, they require a Care Order and must apply for one through the court.

However, if they feel that a child is in danger they can apply for an Emergency Order to take the children from your care, and afterwards go back to court to get a Care Order.

What can I do to prevent it?

If you want to prevent a care order being made, you should speak to us. The Social Services must show that the children are likely to suffer ‘significant harm’ because of the level of care you provide or because the child is beyond your control.

If the child is at risk from an abuser, the court has been given the power to remove the abuser from the home, rather than the child.

We can also help if you wish to get your children back if they have already been taken into care. We can help you apply to discharge the care order, but you must have very good reasons. We will be able to advise you on this.

Supervision Orders

Social Services may take for a Supervision Order which means that you will be supervised when you care for your children. These applications can be challenged. Please speak to us if you are in such a situation.
