February 2008 saw the introduction of the new-look civil penalty scheme on illegal working.

The system was designed to make it more difficult for illegal workers to stay in the UK, and easier for employers to ensure that their employees are eligible to work in the UK. The system is policed by the UK Border Agency (UKBA). The UKBA can come into your premises and do spot checks without warning and it is clear from recent reports that they have increased the number of businesses they are visiting. Fines for employing an illegal worker can be up to £10,000 per illegal employee.

The new legislation has placed a greater responsibility on the employer. Many employers are still unsure of which documents they need to review to meet the legislation's requirements. Also in an increasing number of instances employers are being caught out by forged documentation.
