A tenant’s liability to pay its service charge is governed by the terms of the Lease. A service charge is to intended to recoup the costs of repairing and maintaining areas of common interest to the landlord and multiple tenants. It is not intended to meet the costs of improving the property.

The need to ensure that the communal parts of the property and well maintained and managed needs to be balanced with service charges that are proportionate to the tenant's needs of the property.
