SA Law can advise on, and prepare, the new Lasting Powers of Attorney, which have replaced Enduring Powers of Attorney. Lasting Powers of Attorney, although somewhat more complicated to make than Enduring Powers of Attorney, are intended to ensure that there is no abuse of the Donor of the Power, particularly in circumstances where they lack the capacity to make their own decisions.

A Lasting Power of Attorney can be made to cover property and financial affairs, whilst a separate Lasting Power of Attorney can cover personal welfare, including power to give or refuse consent to treatment.

In cases where a person has not made either an Enduring Power of Attorney or a Lasting Power of Attorney, and sadly lacks the capacity to make decisions about their personal welfare or property themselves, application can be made to the Court of Protection to make decisions on behalf of that person.

This is a complex area of law, in which it is important to take full consideration of an individual’s circumstances and wishes.
